Tragic child abuse leads to a wrongful death suit

Parenthood is the toughest job a person will ever love. This is a refrain that is heard over and over in Tennessee and, indeed, in any state in the country. It also requires a tremendous amount of patience and forbearance. Sadly, not everyone has the same tolerance level, and tragedies can result. One such tragedy resulted in a wrongful death suit against an office of DCS (Department of Child Services).

A young boy recently died from injuries suffered from abuse, and he was only five years old. The boy's father was aware of the situation but had limited contact with his son due to ongoing custody issues. He did place calls to DCS voicing concern for his son's well-being. The child's school also noticed signs of abuse and placed repeated calls to DCS. The school also began documenting the evidence of abuse.

The boy's mother claimed that the boy was hurting himself intentionally; however, some of the injuries the boy endured included a fractured arm and a broken femur. Nevertheless, the mother pulled the boy out of school, and he died about a month later. The father is bringing charges of wrongful death against DCS for what he believes is a failure to act on the information they were given.

The death of a child is one of the hardest life experiences a parent can face. When the death of a child could possibly have been prevented, the sense of loss and grief are that much more devastating. When a parent's grief begins to subside, one may wish to look for answers and possibly a chance to prevent the same fate befalling another child. A person in Tennessee facing such a situation might benefit from a consultation with a personal injury attorney who would be able to advise one on whether a wrongful death suit is a viable option.
