All drivers are aware of the potential of a car crash, but most likely feel relatively safe when they personally are obeying all traffic laws and safety recommendations, especially when they are traveling a familiar stretch of roadway. However, recklessness and distraction by others can put the lives of even the safest drivers at risk in Tennessee. In fact, one family may be considering filing a wrongful death lawsuit after an accident that resulted in the death of their loved one.
According to reports by the Tennessee Highway Patrol, a man and his wife were returning home one afternoon on a day in May. The husband was reportedly slowing to turn into his driveway. Unfortunately, witnesses claim that that the driver of an approaching sports utility failed to respond to the slowing vehicle.
As a result, the SUV allegedly struck the couple’s vehicle in the rear. The husband passed away as a result of injuries he suffered in the collision, leaving behind his wife, three children and grandchildren. Both his wife and the driver of the second vehicle suffered serious injuries in the crash. Police have not said whether criminal charges are expected to be filed against the driver of the SUV, but the accident likely remains under investigation.
Unfortunately, the family of the deceased victim are left unexpectedly planning his funeral, apparently due to an accident that was preventable. For many families in Tennessee, the unexpected loss of a loved one comes with a financial toll as well as an emotional one, making it difficult for them to meet their financial obligations. In cases in which a person’s death was caused by another’s negligence, surviving loved ones have the option of filing a wrongful death lawsuit. A successfully presented case could result in an award of damages, leaving plaintiffs better prepared to pay funeral costs and other expenses stemming from their loss.
