Negligence is the most important aspect of most personal injury cases. Negligence refers to a failure to act with reasonable care. If a person is injured due to another party’s carelessness or negligence, it may form the basis of their claim.

The four elements of negligence

To establish negligence in a personal injury claim, four key elements must be shown:

  1. Duty of care – The person being accused must have had a legal duty to act carefully in the situation.

  2. Breach of duty – That person must have failed to meet their duty of care.

  3. Causation – The failure must have directly caused the injury.

  4. Damages – The injured party must have suffered tangible harm, such as physical injury, emotional distress or financial loss.

All four elements must be present for a negligence claim to succeed.

How negligence is proven

Negligence is usually proven with evidence. This may include photos, video footage, witness statements, expert testimony or medical records. The aim is to show that the harm would not have occurred if reasonable care had been used.

The standard used to judge negligence is what a reasonable person would have done in similar circumstances. If the accused person acted less carefully than this standard, they may be considered negligent.
