Attempt to create summer memories ends in wrongful death suit

Summertime is a time for family outings and enjoying the beauty of mother nature. Children grow up quickly, and summertime is an excellent time to create childhood memories that can last a lifetime. However, mother nature can be very unpredictable where questions of weather are concerned in Tennessee. One family fell victim to a horrible tragedy that may have been preventable. The resulting death of a child has led to a wrongful death lawsuit.

A couple, along with their 2-year-old son, decided to go on a family excursion to Cummins Falls State Park. The park is home to spectacular waterfalls and beautiful rock formations. The day the family was at the park, there was rain in the forecast. The park reportedly did not put into place precautions or additional safety measures.

The park did distribute life jackets to people at the base of the waterfall, but the jackets had to be surrendered before hiking the gorge. It was during such a hike that a flash flood overtook the young family. The father and his son were swept away in the flood waters, and the father was unable to save his son from the rushing water.
