Employment law does not allow age discrimination

A person in Tennessee who has been performing a job successfully should not have to stop performing that job just because of his or her age. Age discrimination is illegal in the United States, and so is a violation of employment law. Age discrimination is also a violation of the Tennessee Human Rights Act.

A complaint has been filed against the Volkswagen Assembly Plant in Chattanooga. According to the complaint, the company made an announcement in June of 2017 that they were going to make some management changes. These changes included offering early retirement packages to people born between 1955 and 1960. The reason given for the change was that it would allow Volkswagen to become "slimmer, leaner and younger."

One person caught up in this situation was told he was being demoted from assistant manager to supervisor. This came right after the announced changes. He was also told that he had a year to find another assistant manager position or his salary would be reduced. In addition, he claims he was prevented from applying for a management position in spite of his manager recommending him for a promotion following a performance review. He was prevented by virtue of the fact that his status was changed to "remain in position," which prevented him from applying for a promotion for one year, even though he had the status of "vertical," which would have allowed for a promotion, following his review.
