Wrongful death lawsuit filed after Tennessee infant dies

When another person's actions result in the death of another, the victim's surviving family members often pursue legal recourse to help reach a form of closure. A Tennessee couple has decided to file a wrongful death lawsuit after their child died while in daycare.

Reports indicate the 4-month-old child was left with a local childcare network. At some point during his day, a staff member put the child down for a nap on some blankets on the floor. The child was left unattended for some time and rolled over onto his stomach. When childcare workers came to check on him, he was unresponsive. No one present at the time of the incident attempted to perform CPR on the child to revive him.

After an investigation, the facility was found to have committed at least four violations. Authorities say that the child should have been supervised, even while napping. The staff was also required by law to be trained on and implement CPR when necessary, which they did not. The parents request a trial by jury and are asking for $5 million in compensatory damages.
